Terms of Service

Welcome to Myna. These Terms of Service ("Terms") govern your access to and use of the Myna mobile application ("App," "Service," or "Platform"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using Myna, you agree to:

• Comply with these Terms of Service
• Comply with our Privacy Policy
• Comply with all applicable laws and regulations
• Be responsible for your use of the Service

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

Myna is an artistic photo transformation and AI image generation application that provides the following services:

• Local Filter Transformation: Apply on-device image filters to convert your photos into various artistic styles with instant previews
• AI Text-to-Image Generation: Create images from text descriptions using AI technology (10 free generations per day)
• Community Feed: Publish, view, like, and interact with artworks created by other users
• User Profiles: Create and manage your personal profile (username, avatar, and bio)
• Private Messaging: Send and receive private messages with other users
• Content Management: Save artworks to your device's photo album and publish them to the community feed
• Content Moderation: Report inappropriate content and block users to maintain a safe community

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. Account Registration and Security

3.1 Account Creation

To access certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

3.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in activities that harm the Service or other users.

4. User Content and Conduct

4.1 Your Content

You retain ownership of the photos you upload and the artworks you create. When you publish artworks to the community feed, you grant Myna a non-exclusive, worldwide, royalty-free license to display your published content within the App for the purpose of operating the community feed feature.

Local Processing: Photos processed with local filters are processed entirely on your device. We do not upload or store these photos on our servers unless you choose to publish the resulting artwork.

AI Generation: Text prompts submitted for AI image generation are sent to our AI service provider for processing. The generated images belong to you, and you can choose to save them locally or publish them to the community.

4.2 Content Restrictions

You agree NOT to upload, create, or send content (including artworks, published content, and private messages) that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
• Infringes on intellectual property rights of others
• Contains nudity, sexually explicit material, or adult content
• Promotes violence, discrimination, or hatred
• Contains personal information of others without their consent
• Violates any applicable laws or regulations
• Contains malware, viruses, or harmful code
• Impersonates any person or entity
• Constitutes spam or unauthorized advertising

4.3 Community Guidelines

When using the community and messaging features of the App, you agree to:

• Be respectful and courteous to other users
• Not engage in harassment, bullying, or abusive behavior in public posts or private messages
• Not manipulate likes or other engagement metrics
• Not send unsolicited or spam messages to other users
• Report inappropriate content or behavior using the reporting tools
• Respect the intellectual property and privacy of others

5. Intellectual Property Rights

5.1 Our Rights

The App, including its design, features, graphics, code, and content (excluding user-generated content), is owned by Myna and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

5.2 AI-Generated and Filtered Content

Local Filters: Artworks created using our on-device filters are yours to use as you wish. The filter effects are applied to your original photos on your device.

AI-Generated Images: Images created using our text-to-image feature are generated based on your prompts. While you may use these AI-generated artworks for personal purposes, you acknowledge that:

• AI-generated content may have limitations on commercial use depending on the AI service provider's terms
• Similar artworks may be created by other users using similar prompts
• You are responsible for ensuring your use of AI-generated content complies with applicable laws
• Daily generation limits (10 per day) apply to ensure fair usage and service quality

5.3 Trademarks

Myna and our logo are trademarks of Myna. You may not use our trademarks without our prior written consent.

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our collection and use of your information as described in the Privacy Policy.

• Photos processed with local filters are processed entirely on your device
• Text prompts for AI generation are sent to our AI service provider
• We do not sell your personal information to third parties
• You control what artworks you publish to the community feed
• You can delete your messages, published content, and account at any time

7. Reporting and Blocking

We provide tools to help maintain a safe and respectful community:

• Reporting: You can report content or users that violate these Terms or our Community Guidelines
• Blocking: You can block users to prevent them from viewing your content or interacting with you
• Content Moderation: We review reported content and take appropriate action, which may include content removal or account suspension

We are not obligated to review all content but reserve the right to remove any content that violates these Terms.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Guarantees that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy, reliability, or quality of filtered or AI-generated content
• Guarantees regarding the availability of AI generation services or daily quota limits
• Guarantees that defects will be corrected

Local filters and AI technology may produce unexpected or imperfect results. We do not guarantee the quality, accuracy, or suitability of filtered or AI-generated artworks for any particular purpose. AI generation quotas and availability may change without notice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYNA SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the Service
• Unauthorized access to or alteration of your content
• Conduct or content of third parties on the Service
• Any claim related to filtered or AI-generated content
• Unavailability of AI generation services or changes to daily quota limits

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Myna, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your content uploaded to the Service
• Your use of AI-generated content

11. Third-Party Services

The App uses third-party AI services to generate images from text prompts. These services are subject to their own terms and conditions. We are not responsible for the performance, availability, or policies of these third-party AI services. Local filter processing is performed entirely on your device and does not involve third-party services.

The App may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of these third parties.

12. Geographic Restrictions

The Service is controlled and operated from our facilities. We make no representations that the Service is appropriate or available for use in all locations. Access to the Service from territories where the content is illegal is prohibited.

13. Export Compliance

You agree to comply with all applicable export and import control laws and regulations in your use of the App. You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country.

14. Dispute Resolution

14.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@Myna.com. We will attempt to resolve the dispute informally within 60 days.

14.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Myna operates, without regard to conflict of law provisions.

14.3 Arbitration

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, rather than in court.

15. Changes to the Service

We reserve the right to:

• Modify or discontinue any feature of the Service
• Update filter styles and AI models
• Adjust daily AI generation quotas or introduce new usage limits
• Change pricing or introduce new fees (with appropriate notice)
• Impose limits on certain features or storage

We will make reasonable efforts to notify you of significant changes to the Service.

16. Termination

You may stop using the App at any time. To delete your account, please contact us at the email address below.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• At our discretion for business or operational reasons

Upon termination, your right to use the Service will immediately cease, and we may delete your account and content.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Myna regarding the use of the Service and supersede any prior agreements.

19. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision must be in writing and signed by us.

21. Acknowledgment

BY USING THE MYNA APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
